1. Introduction
By using the Cybotech Europe website or purchasing robotic equipment from us, you agree to the following Terms and Conditions. These govern both your use of the site and all equipment sales. If you do not agree, please do not use our services.
2. Website Terms of Use
Purpose: Our website is for general information and enquiry only. We do not display live product listings or offer transactional services online.
Ownership: All content is owned by Restock Resources Ltd t/a Cybotech Europe. You may not copy, reuse, or reproduce content without written permission.
Accuracy: Information is provided in good faith but may be subject to updates, corrections, or changes at any time.
Use Restrictions: You agree not to misuse the site, introduce harmful content, or interfere with its security or availability.
Links: We are not responsible for the content of external sites linked from ours.
Privacy: Personal data submitted is handled according to our Privacy Policy.
Disclaimer: The site is provided “as is”. We exclude all warranties to the maximum extent permitted by law.
Limitation of Liability: We accept no liability for loss arising from use of the website.
3. Terms of Sale
3.1 Contract Formation
Quotations are invitations to treat, not binding offers.
Orders are only accepted once confirmed in writing or by invoice.
We may decline or cancel orders prior to confirmation without liability.
All sales are final unless otherwise agreed in writing.
3.2 Prices & Payment
All prices are in GBP and exclude VAT, duties, and shipping unless stated.
Full payment is usually required in advance, unless agreed otherwise.
Late payments may incur interest at 1.5% per month and collection costs.
Goods remain our property until paid for in full.
3.3 Delivery & Risk
Delivery is Ex Works (EXW), unless otherwise agreed.
Risk transfers to the buyer upon collection or loading onto carrier transport.
We can assist with shipping, but we are not liable for loss or damage in transit.
Buyer is responsible for import/export compliance and any duties or taxes.
Delivery dates are estimates only.
3.4 Inspection & Acceptance
Goods are sold "as seen", with all faults. Buyers are encouraged to inspect prior to sale.
Claims must be made within 5 working days of delivery; after that, goods are deemed accepted.
We may, at our discretion, repair, replace, or refund in the case of verified, material non-conformity.
3.5 Warranty Disclaimer
We provide no warranty unless explicitly stated.
Equipment is sold “as is, where is, as seen” with no implied fitness or merchantability.
Any remaining manufacturer warranty (if applicable) is the responsibility of the buyer to claim.
3.6 Buyer Responsibilities
Buyers are fully responsible for installation, safety compliance, and lawful use.
Cybotech is not liable for accidents, damage, or misuse of the equipment post-sale.
3.7 Indemnity
Buyers agree to indemnify Cybotech against claims, losses, or liabilities arising from use, misuse, resale, or integration of the equipment.
3.8 Limitation of Liability
Our total liability is limited to the value of the goods sold.
We are not liable for indirect, incidental, or consequential losses including profit, downtime, or third-party claims.
Nothing excludes liability for death, personal injury due to negligence, or fraud.
4. General Legal Terms
Entire Agreement: These terms and any written quote or invoice form the entire contract.
No Waiver: Failure to enforce any term is not a waiver of that term.
Severability: If one term is invalid, the rest remain enforceable.
Assignment: You may not transfer your rights without our consent.
Governing Law: These terms are governed by English law.
Jurisdiction: All disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
